General Terms and Conditions (GTC) – AGBs

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts between Chris Princic hereinafter referred to as „Artist“ and the client hereinafter referred to as „Customer“ regarding the provision of mural painting services, particularly for creating murals.

2. Description of Services

The Artist offers mural painting services for indoor spaces. The services include designing and executing murals and other artistic works in accordance with the agreed specifications.

3. Conclusion of Contract

The contract is concluded by the acceptance of the Artist’s offer by the Customer. The offer is binding upon receipt and confirmation by the Artist.

4. Deadlines and Timeframes

All specified deadlines are estimated delivery times and subject to change. The Artist commits to completing the work by the agreed completion date, unless unforeseen circumstances (e.g., illness, delivery delays, or force majeure) cause a delay.

The Customer is obligated to approve a layout for the mural one week before the start of the painting so that the Artist can make the necessary preparations.

5. Delay and Compensation

If the Artist or the Customer must postpone an agreed appointment, both parties are required to notify the other party at least 7 days in advance and arrange a new start date.

Compensation Clause

In the case of a delay in the execution of the work or non-compliance with the agreed start date by the Customer within this 7 days, a compensation fee of 1,000 EUR per day will be charged for the incurred damages.

6. Payment Terms

The price for the service is set in the offer and is generally due after the completion of the work and the Customer’s acceptance, unless otherwise agreed. Payments are due within 14 days of the invoice date without any deduction for frame paintings.

The Customer has 6 weeks to pay the invoice after receiving an international mural. The date of the first invoicing applies. After this period, late payment fees will apply on a daily basis and will be charges with percentages on top.

7. Acceptance

The Customer is required to inspect the completed work upon completion. After the acceptance of the finished mural, any new items or corrections not included in the original cost estimate (KV) will be charged separately.

8. Liability

The Artist is not liable for damages caused by simple negligence. The Artist is liable for damages resulting from gross negligence or intentional acts, within the limits permitted by law.

9. Data Protection

The processing of the Customer’s personal data will be carried out in accordance with the applicable data protection regulations. The Customer has the right at any time to request information about their stored data and to request its correction or deletion.

10. Final Provisions

Austrian law applies. The place of jurisdiction for all disputes arising from this contract is the location of the Artist.
